051 – The Living Will and Decision Making Capacity

The advanced directive for health care (otherwise known as the living will) doesn’t take effect until the person who created it lacks decision making capacity.  Until then they can manage their own medical decisions.  Once they lack capacity medical providers will look to the instruction directive for guidance and work with the health care representative to make decisions.  But when does someone lack decision making capacity?  Listen to this episode to find out.

050 – Four Ways to Build a Living Will

An advance directive for health care (also known as a living will) can include an instruction directive (where you outline care you do or do not want) and a proxy directive (where you appoint someone to speak on your behalf). There are four main ways to build an advanced  directive.  They include:

  • Proxy directive alone
  • Instruction directive alone
  • Instruction directive with a health care representative appointed – specific direction
  • Instruction directive with a health care representative appointed – decision making tracks

049 – Living Wills – An Overview

An Advance Directive for Health Care (also known as a Living Will or a Medical Power of Attorney) is a document that preserves your right to direct your own medicaid decisions in situations where you lack the capacity to express them for yourself.  In one part of the Advance Directive you can prepare an instruction directive where you spell out the care you do or do not want.  In a different part you can appoint a health care representative to speak on your behalf if you can no longer do so.  Your document can have one or both parts.  Advance directives are very important for end of life care – especially for those with Alzheimer’s disease and other types of dementia.   Listen to the episode to learn more about them.
